This article discusses various aspects of the attorney-consultant relationship in environmental litigation. This complex relationship cannot be fully explored, yet key guidelines are set forth. The guidelines have been developed from both the attorney’s and consultant’s standpoint. Second, the need for credible and reliable consultants will be focused upon, since the choice of the consultant is the key step in order to identify environmental impairments and achieve cleanup. Key issues regarding an environmental consultant’s liability will now be examined. In 1993, the ASTM released its Standard Governing Phase I Environmental Site Assessments for Commercial Real Estate. The impact of this Standard on environmental consultants will be explored.
